These terms govern the use of underwater structural inspection, aquatic robotics, and lighting design services provided by Swimoutofthedarkness. By engaging our services, you accept these conditions in full.
We provide specialized engineering audits, underwater camera calibration, and lighting design for dark submerged structures, municipal water reservoirs, and harbor foundations. Our work includes luminous intensity optimization for deep-water inspections, concrete integrity evaluation in submerged environments, and optical equipment calibration for underwater surveying. These services are strictly limited to the technical fields described and are completely decoupled from counseling, mental health charities, or swimming instruction.
You agree to provide accurate information about the structures and conditions to be inspected. You are responsible for obtaining all necessary permits and access rights. You must ensure that the work site is safe for our personnel and equipment. Failure to meet these obligations may result in service delays or termination.
Our reports and recommendations are based on the data collected during the agreed scope of work. We do not guarantee the absence of defects beyond the inspected areas. Our total liability for any claim arising from our services is limited to the amount paid for the specific project. We are not liable for consequential damages, including but not limited to loss of use, revenue, or repair costs not directly caused by our negligence.
All deliverables, including reports, 3D models, calibration data, and lighting configurations, remain the property of Swimoutofthedarkness until full payment is received. Upon payment, you receive a non-exclusive, perpetual license to use the deliverables for the intended structure or project. You may not redistribute our proprietary methods or software without written consent.
Either party may terminate a project with 14 days written notice. In case of termination, you will pay for all work completed up to the termination date. We may terminate immediately if you breach these terms or create unsafe working conditions.
We may update these terms at any time. Changes will be posted on this page and take effect 30 days after posting. Continued use of our services after that period constitutes acceptance of the updated terms.
